General Provisions

  1. The controller of personal data within the meaning of Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “GDPR”) is Marek Rychtar, Business ID 08739510, with its registered office at Nádražní 101, 702 00 Ostrava-Přívoz, Czech Republic (hereinafter referred to as the “Controller”).

3. Personal data means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

4. The Controller has / has not appointed a Data Protection Officer (DPO).

Sources and Categories of Processed Personal Data

  1. The Controller processes personal data provided by you or personal data obtained by the Controller in connection with the fulfilment of your order
  2. The Controller processes your identification and contact details, as well as any data necessary for the performance of the contract.

Legal Basis and Purpose of Personal Data Processing

  1. The lawful basis for processing personal data is:

    • Performance of a contract between you and the Controller under Article 6(1)(b) of the GDPR,

    • The legitimate interest of the Controller in providing direct marketing (in particular for sending commercial communications and newsletters) under Article 6(1)(f) of the GDPR,

    • Your consent to the processing of personal data for the purpose of direct marketing (especially for sending commercial offers and newsletters) under Article 6(1)(a) of the GDPR, in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, in cases where no order for goods or services has been placed.

  2. The purpose of processing personal data is:

    • To process your order and perform the rights and obligations arising from the contractual relationship between you and the Controller.
      When placing an order, the following personal data are required to successfully process the order — name, address, and contact information. Providing personal data is a necessary requirement for concluding and fulfilling the contract; without this information, it is not possible to conclude or perform the contract.

    • To send commercial communications and conduct other marketing activities.

  3. The Controller does not engage / engages in automated individual decision-making within the meaning of Article 22 of the GDPR.
    Where such processing occurs, your explicit consent has been obtained.

Data Retention Period

  1. The Controller retains personal data:
    • For the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller, and to assert any claims arising from such relationships (for a period of 15 years after the termination of the contractual relationship).

    • For the period until consent to the processing of personal data for marketing purposes is withdrawn, but no longer than 5 years, if the personal data are processed based on consent.

2. After the expiry of the retention period, the Controller shall erase the personal data.

Recipients of Personal Data

  • The recipients of personal data are individuals or entities:

    • involved in the delivery of goods / provision of services / processing of payments under a contract,

    • involved in ensuring the operation of services,

    • providing marketing services.

  • Access to your personal data is granted only to authorized employees of RB Digital and its contracted partners.
    For the purpose of performing additional data processing operations, the Controller uses the services and applications of processors who are capable of ensuring proper data protection and specialize in such processing.

    • Instagram

    • Google

    • TikTok

    • YouTube

    • LinkedIn

  • Data are processed exclusively within the European Union or in countries that ensure an adequate level of data protection as determined by a decision of the European Commission.

Your Data Protection Rights

  • Under the conditions set out in the GDPR, you have the following rights:

    • The right of access to your personal data pursuant to Article 15 of the GDPR,

    • The right to rectification of personal data under Article 16 of the GDPR, or the right to restriction of processing under Article 18 of the GDPR,

    • The right to erasure (“right to be forgotten”) under Article 17 of the GDPR,

    • The right to object to the processing of personal data under Article 21 of the GDPR,

    • The right to data portability under Article 20 of the GDPR,

    • The right to withdraw consent to data processing at any time, either in writing or electronically, by contacting the Controller at the postal address or e-mail address specified in Article III of these Terms.

  • You also have the right to lodge a complaint with the Office for Personal Data Protection (Úřad pro ochranu osobních údajů) if you believe that your data protection rights have been violated.

Personal Data Security Measures

  1. The Controller declares that it has implemented all appropriate technical and organizational measures to ensure the security of personal data.

  2. The Controller has adopted technical measures to secure both data storage systems and paper-based personal data records.

  3. The Controller further declares that access to personal data is granted only to authorized persons appointed by the Controller.

Final Provisions

  • By submitting the contact form, you agree to these terms and conditions.
    By doing so, you confirm that you have read and understood the Privacy Policy and that you accept it in its entirety.

  • The Controller reserves the right to amend these terms at any time.
    The updated version of the Privacy Policy will be published on the Controller’s website or, if applicable, sent to your e-mail address provided to the Controller.
